Steve Bannon loses emergency SCOTUS appeal to delay prison sentence

Steve Bannon, the former aide to President Donald Trump who was ultimately held in contempt of Congress and sentenced to prison, will have to serve his sentence with no delay. 

According to The Hill, Bannon attempted to have the Supreme Court intervene in delaying the sentence, but the high court, in a one-sentence order with no dissent, ordered the original sentencing timeline to remain in place.

Bannon will have to report to prison on Monday, as originally ordered.

The former Trump aide will be the second in the former president's stable of previous aides to do prison time over defying a subpoena from the House Jan. 6 committee.

What's happening?

The Hill explained what got Bannon to the point of filing an emergency appeal with the Supreme Court.

Two years ago, a federal jury in Washington, D.C., convicted Bannon on two counts of contempt of Congress for failing to appear for a deposition before the Jan. 6 panel and refusing to turn over subpoenaed documents.

Bannon was able to delay the sentence previously because his trial judge allowed him "to delay his sentence because of a federal law that keeps defendants free if their appeal presents a substantial legal question likely to result in a reversal or new trial."

His efforts to appeal ultimately failed in the first stage, which allowed federal prosecutors to request an end to the delayed sentence.

R. Trent McCotter, Bannon’s lawyer, attempted to argue to the high court that his client shouldn't have to serve the sentence at this time.

"There is also no denying the fact that the government seeks to imprison Mr. Bannon for the four-month period immediately preceding the November presidential election. There is no reason for that outcome in a case that presents substantial legal issues," McCotter wrote to the justices.

Clearly, his lawyer's argument failed to convince the conservative majority high court.

Bannon speaks out

In the lead-up to his prison reporting date, Bannon has made a number of statements.

"Steve is a great and Patriotic American. Retribution and fair-play will be biblical in Trump's second term," one X user wrote.

Another X user wrote, "That’s a badge of honor. When Donald returns to the White House, Pelosi and Garland will be the ones heading to prison"
